TERMS OF USE
These Terms of Use are a binding agreement between you and Us vs AI, LLC ("Us vs AI," "we," "us," or "our"), the owner and operator of usvsai.gg and its related apps. By using the public beta, you agree to these Terms.
Us vs AI is an independent experimental game and live benchmark. You agree to use it lawfully and not interfere with the service, automate abusive traffic, attempt to obtain hidden puzzle answers, or manipulate benchmark results.
Age
The public beta is intended for users age 13 and older. The beta does not knowingly collect personal information from children under 13.
No gambling or prizes
The public beta does not offer cash prizes, wagers, paid entry, or anything of monetary value based on game outcomes. Scores and leaderboards are for entertainment and benchmark comparison only.
AI-provider names
Names such as ChatGPT, Claude, Gemini, Grok, and DeepSeek may be used descriptively to identify the model or provider that participates in a benchmark day. Us vs AI is not affiliated with, sponsored by, or endorsed by those providers unless a future partnership is expressly stated.
Ownership and limited license
The service, original puzzles, artwork, software, scoring systems, datasets, and Us vs AI branding are owned by or licensed to Us vs AI, LLC and are protected by applicable intellectual-property laws. Subject to these Terms, Us vs AI, LLC grants you a limited, personal, nonexclusive, nontransferable, revocable license to use the service for its intended entertainment and benchmark purposes. No other rights are granted.
Benchmark limitations
Us vs AI is not an official benchmark from any AI provider. Results reflect the specific model configuration, puzzle set, scoring version, and protocol used on that date. They should not be interpreted as a complete measure of intelligence, safety, reliability, or overall model quality.
Fair play
Do not use automation, hidden-answer extraction, multiple coordinated attempts, or other methods intended to distort public statistics. We may exclude suspicious or technically invalid runs from aggregate results.
Availability and changes
The beta may change, pause, reset statistics, or become unavailable without notice. Features, scoring formulas, model rosters, and benchmark rules may evolve, but historical benchmark records should retain the versions used when they were created.
Disclaimer
The beta is provided on an as-is and as-available basis to the extent permitted by law. Use it for entertainment and experimental comparison, not for decisions where errors could cause financial, medical, legal, safety, or other serious harm.
Third-party services
The service depends on third parties including hosting, database, authentication, payment, advertising, and AI-model providers. Us vs AI, LLC does not control those services and is not responsible for their independent terms, availability, or conduct.
Limitation of liability
To the fullest extent permitted by law, Us vs AI, LLC and its members, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use arising from the service. To the fullest extent permitted by law, their total liability for all claims relating to the service will not exceed the greater of $100 or the amount you paid Us vs AI, LLC during the 12 months before the claim. Some jurisdictions do not allow certain limitations, so part of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Us vs AI, LLC and its members, officers, employees, and contractors from claims, losses, liabilities, and expenses arising from your unlawful use of the service or your material violation of these Terms.
Premium membership
The daily five-game battle is free. Optional Premium subscriptions add one ten-round Atlas-only match per day, one retry of the same five daily games, the Arcade, Arcade personal-best statistics, extended history, and a custom player character. The original attempt and reattempt are saved separately. The higher completed match is used for the player's daily standing, while every valid round from both completed matches contributes to aggregate human scores. Atlas-only scores are stored separately. Premium does not change AI benchmark results.
The selected price and billing interval appear before you confirm in Stripe Checkout. Subscriptions renew automatically until canceled. Manage your subscription, payment details, and invoices in Membership on your profile. Cancellation takes effect at the end of the paid period; deleting your account cancels the subscription and ends access immediately. Changing plans may create a prorated charge, which Stripe displays before confirmation.
Friend invites and renewal rewards
An eligible new paying customer who uses a personal referral link before their first annual Premium purchase can purchase the first year for $20. The normal annual renewal is $29.99 before applicable tax. The original inviter earns a discount on their own next annual renewal: one qualifying friend makes it $15, two $10, three $5, and four or more makes the membership renewal free.
Only a successful first $20 annual payment qualifies. Clicks, free accounts, trials, existing paying customers, self-referrals, duplicate accounts used to refer yourself, refunded purchases, and disputed payments do not qualify. We credit the first valid invitation linked to the account; a referral link is remembered on that browser for up to 30 days before sign-in. Every member earns only from their own direct invitations.
Rewards apply once to an eligible annual renewal and cannot be exchanged for cash, refunded against an earlier payment, or combined with another promotion on the same bill. All qualifying referrals earned before that renewal bill is created are used together, capped at one free year; extra referrals from that group do not bank additional years. Referrals earned after the bill is created count toward a later annual renewal. After the rewarded year, the normal annual price resumes unless new referrals earn another discount. Rewards applied to an issued bill are not paid out or clawed back as cash.
While the site is private, checkout is labeled as a sandbox and accepts test payments only. Sandbox memberships are for testing and do not become paid memberships at public launch.
Founder accounts and avatar items
An account that activates qualifying Premium access by the end of October 31, 2026 in the site’s fixed UTC−5 timezone (before November 1, 2026 at 12:00 a.m. UTC−5) receives a limited Founder avatar pack. Test-mode Stripe subscriptions do not qualify. Founder items stay unlocked for that account after Premium ends, but have no cash value, cannot be transferred, and are removed if the account is deleted. Additional cosmetic items and animated auras may be granted by Us vs AI.
Test Scores data
Test Scores subscriptions and public downloads are currently unavailable. Us vs AI continues to retain de-identified game scores and AI benchmark observations for internal analysis. If downloads are offered later, the price and terms will be shown before purchase.
Suspension and termination
Us vs AI, LLC may suspend or terminate access, remove invalid results, or protect the service when reasonably necessary to address fraud, abuse, security threats, nonpayment, unlawful conduct, or a material violation of these Terms.
Governing law and severability
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where applicable law requires otherwise. If any provision is found unenforceable, the remaining provisions will continue in effect.
